1. Acceptance of Terms of Service

By accessing and using the My Better Balcony website and purchasing our products, you accept and agree to be bound by the terms and conditions of this agreement.

2. Jurisdiction and Choice of Law

Customer (purchaser) expressly agrees that any and all claims which may arise from the purchase and use of any My Better Balcony LLC product or products shall be governed and construed in accordance with the laws of the State of Arizona. Customer (purchaser) and My Better Balcony Products LLC hereto expressly consent to the exclusive jurisdiction of the federal and state courts of Arizona located in Maricopa County, Arizona.

3. Warnings & Safety Usage Guidelines

To ensure safe and proper use of your products, please review and follow the guidelines below:

Child Safety Warning:
DANGER - Keep children away from tabletop(s) and hanging garden(s) because they could be used as climbable objects. Always supervise children on balconies and remove any climbable objects nearby.

Maximum Load Capacity:
Do not exceed a total weight of 30 lbs on the tabletop at any time. The tabletop is NOT intended to be sat on, stood on, or used to hold more than 30 pounds.

Electrical Safety (Charging Station):
If your unit includes a built-in charging station, it is strongly recommended to plug it into a GFCI (Ground Fault Circuit Interrupter) outlet. If a GFCI outlet is not available, unplug the unit when not in use.

Folding Cap Usage:
Do NOT place any items on top of the tabletop or hanging garden folding cap piece under any circumstance. The purpose of this warning is to ensure nothing falls over the balcony.

Weather Precautions:
Remove the tabletop during inclement weather conditions, including high winds, storms, drizzle, snow or extreme heat, to prevent damage or injury.

Installation & Setup:
Due to the weight of the product (approximately 25 lbs), it is recommended that two people handle setup and installation.

Spill Awareness:
Exercise caution with liquids. Avoid spilling drinks near or onto the charging station, as this may cause damage or create a safety hazard.

Our products are intended for residential balcony use only. Users must follow all installation instructions and safety guidelines. Misuse, modification, excessive weight, or improper installation may result in damage or injury and will void any implied warranties.

My Better Balcony does not provide warranties beyond shipping damage or defects present at delivery. Any other claims, including damage resulting from outdoor exposure, misuse, or normal wear, are excluded.

4. Limitation of Liability

To the maximum extent permitted by law, My Better Balcony, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, property damage, or loss of use, arising from or related to the purchase, use, or inability to use our products, whether caused by negligence, misuse, or other causes.

5. Shipping and Delivery

Please allow 1-2 weeks for shipping as all items are handmade to order. Shipping costs are calculated at checkout based on destination.

6. Returns and Exchanges

We want you to be confident in your purchase. Returns or replacements are accepted only for items damaged during shipping and must be reported within 72 hours of delivery.

• Damage must be reported within 72 hours of delivery, including clear photos of the product, packaging, and damage.
• The original packaging must be retained, and the product must not be installed, used, or modified after delivery.
• Returns must be approved by My Better Balcony before shipment; unauthorized returns will not be accepted.

Approved returns or replacements for shipping damage will be covered by My Better Balcony. We do not accept returns or exchanges for reasons such as incorrect color selection, size, or railing compatibility.
